Penal Codes Affecting Air Taser, Stun Guns & Stun Batons
Illinois: Restricted
In order to possess a Taser or stun gun, an individual must have a valid FOID card, as is currently required for firearms.
Sellers of Tasers or stun guns must check the buyer’s FOID card and keep the record of sale for ten years, the same requirements for firearms sales. When a licensed firearms dealer sells a Taser or stun gun, they must request a background check of the buyer. The 24-hour waiting period required for long guns, shotguns, and rifles also applies to Taser and stun gun purchases.
Massachusetts: Legal
Stun guns are legal, but the owner needs a carry permit. The stun gun must be secured in a locked container that only the permit holder can access.
Michigan: Legal
After a Michigan court ruled the state’s ban on stun guns illegal, the law was amended to allow civilian possession and use of Tasers with a concealed pistol license. This does not apply to regular stun guns.
Rhode Island: Illegal
Under Title 11, Chapter 47, Subsection 11-47-42 of Rhode Island’s General Laws, no person may carry or possess a stun gun. Violators may face up to a $500 fine, one year in prison, or both. Possession and use of stunning devices are banned.
Wisconsin: Legal with Restrictions
Under Wisconsin CCW (Carrying Concealed Weapons) laws:
-
You may possess or carry an electric weapon only if you have a CCW license or recognized out-of-state license.
-
You may have a stun gun in your own home, business, or land that you legally occupy.
-
You may transport a stun gun if it is enclosed in a carrying case.
Selling stun guns in Wisconsin is restricted. They may not be sold to anyone who doesn’t hold a valid CCW license or law enforcement credentials. Violations are a felony.
City/County Restrictions
Chicago, IL: Illegal
Possession and sale of stunning devices are banned in the City of Chicago. Some city ordinances require waiting periods or formal applications for registration. More information may be required on local enforcement.
